HAPPINESS....AS A RIGHT FOR EVERYONE????
ARE YOU ABSOLUTELY SURE??'
To understand if the right to happiness can become the object of a constitutional right, we must understand what the state must do to realize the right of individuals to happiness. SO LET'S FOCUS ON THESE 2 MAIN POINTS:
1. what role should the state play ?
2. what should it do to guarantee the right to happiness???'
so the CLASS COOPERATIVE WORK HAS BEEN ORGANIZED IN THIS WAY:
PHASE 1: reflect on THE RIGHT TO HAPPINESS and search for THE CONSTITUTIONS that have included it among the principles.
The reflection must highlight the relationship between
THE INDIVIDUAL
AND THE COLLECTIVE HAPPINESS
WHAT MAKES A PERSON HAPPY?AND WHICH IS THE ROLE OF THE STATE?
The United States Declaration of Independence of 1776
The Declaration of Independence guarantees
the right to "life, liberty and the pursuit of happiness."
in addition The General Assembly of the United Nations in its resolution 66/281 of 12 July 2012 proclaimed 20 March the International Day of Happiness t by declaring pursuit of happiness is a fundamental purpose of humanity
PHASE 2:
Express personal reflections on the following sentence explaining what you mean by individual happiness and collective happiness (do they coincide, what are the differences?)
“All human beings want to be happy;
but, in order to reach such a condition,
one must begin by understanding what is meant by happiness. "
(Jean-Jacques Rousseau)
PHASE 3.
Let's take into consideration the United Nations World Happiness Report which proposes a ranking of the (happiest) countries.
In your opinion, what could be the indicators to be used in this ranking?
To understand if the right to happiness can become the object of a constitutional right, we must understand what the state must do to realize the right of individuals to happiness. Try to describe what role the state should play or what it should do to guarantee the right to happiness
LET'S GET TO THE CORE ACTIVITY
it is not enough to insert a new article that recognizes the right to happiness for it to be realized;
1. our ITALIAN CONSTITUTION contains already the road to the right to happiness.
2.The right to happiness is TRANSVERSAL to other constitutional rights
PHASE 1
let's verify the presence of the RIGHT TO HAPPINESS
in the Italian Constitution through the interpretation of the articles
Students are given the first 12 articles of the Italian constitution and are asked to find those that could have an implicit reference to the right to happiness
PHASE 2 the class is divided in groups and each group has a LABYRINTH to complete with the twelve articles.
PHASE 3
Students, at this stage, are asked to interpret them in a personal way, through their own experience, their emotions.
So The students divided into groups
- chose the articles
- made their comments
- INSERTED in a labyrinth the phrases chosen by the group to tell the normative path towards the right to happiness. This was a NEW LABYRINTH they personally designed
- decided if HAPPINESS is a point of arrival at the CENTRE of the labyrinth or AN EXIT
BUT WHY A LABIRINTH?
The labyrinth is chosen because
1. it never translates into a static form, but it develops
2.it also allows you to achieve greater awareness of the complexity of the path
3. it makes you realize THE RISK AND HOW IS DIFFICULT TO FOLLOW THE RIGHT DIRECTION
PHASE 4 the students divided into groups redesigned and reinterpreted the labyrinth,
in LABYRINTH 1 sudents wrote:
Article 32 says that the Republic shall protect the HEALTH as a basic right of the individual and as an interest of the community, and shall grant free medical care to the poor.
so STUDENTS commented by saying that they FEEL HAPPY when they feel physically and mentally healthy.....
