Common standards, influence of European regulations

  • It was our task to deal with the regulations and laws of the members of the European Union. Each member state is ordered to follow the rules. In the following, we will name you a few examples for such principles. For example to protect national parks and historical statues. Further food products are not allowed to be taxed, Bio products must be tagged and you are able to refund online products in the gap between one to seven days.

    Male and female must be treated the same since the Eu does not allow any difference between our genders. Aswell you are not bound to provide any kind of ID verification at the borders of the member states, even though some border patrol ask for it. The regulations are determind by the European Commission, the European Parlament and the European Council. These three judicatives decide democratically, if a law gets declarated or not. But the most important rule is the same currency, the Euro, which is responsible for financial stability in our states.

    Italy

    Article. 113bis of Council Regulation (EC) stated that the fresh fruit and vegetables, to be marketed, must be of sound, fair and marketable quality and must indicate the country of origin.
    Regulation (EU) which has recently reformed the common organization of the market, even for the fruit and vegetable sector, confirming what was previously arranged, dictating the same provisions in Article  76 of that Regulation.

    The above provisions shall be implemented by means of marketing standards contained in the Implementing Regulation (EU), of which 10 are specific for as many products (apples, pears, citrus fruit, peaches and nectarines, lettuce and endives, sweet peppers, strawberries, grapes , kiwi and tomato) and a general reference to other fruit and vegetables covered by the Organization of the Common market Organisation (CMO).

    The application of these Community rules requires the establishment of a system of checks carried out on the basis of a risk analysis in all stages of marketing, except for some specially exempted products

    Hungary

    foodstuffs intended for particular nutritional uses

      The provisions of this Regulation shall be applied to foodstuffs intended for Hungary, placed on the market that meet as a result of specific procedure for special composition or during the preparation of the particular nutritional purposes (hereinafter referred to as special foods), clearly distinct from the general public consumption made from foodstuffs, and for the suitability of the clear expressed in symbols, when put into circulation.
      The special food must be met:
      -the special dietary needs of consumers:
      -is digestive or metabolic disorder suffer
      - Whose consumption due to specific physiological state of a certain material benefit fully checked and

      healthy infants and young children with special dietary needs.

    German law

    The city and state Berlin has no ropeway, but they have to introduce a ropeway-law made by the EU. Berlin first hadn`t seen a reason in having this regulation, but the Eu let them know that if they don`t accept it, an amount of 791.000 euros have to be paid for not accepting the Eu-law.

    In addition, the Salt content of bread is regulated by the European Union, to protect the health of the European bread consumer.

    Some of the principles are very bizare for example a standard size for condoms of 16 centimetres or a maximum - bending of bananas and cucumbers.

    There are a few more of such regulations, that sound funny for us and hard to believe, but there are also a lot of very important ones, and before you judge bad about the regulations , don`t mind the fact that most of the stupid seeming rules are proposed by the memberstates themselves and are not developed without a reason.

     

    Usage of EU-Guidelines

    Unlike the regulations, European directives do not apply directly in the individual European countries. If the European legislature allows a directive, the regulations of this directive can not be applied directly in Germany or in the other European countries. Firstly, the German, French and other national legislatives have to adopt their own laws implementing the regulations of the directive. The german legislation is therefore needed in order for the directive to be activated in germany as well, and to give the rights to citizens.

    The european directive is initially directed only at the national legislator. This national legislator is then obliged to create national (German) laws that implement what the directive says. For this purpose, he has a certain period of time available until he must have completed the transposition into national law. If he needs longer, he will be punished. Only the transposition by the national legislator leads to the fact that the provisions of the directive on applicable and applicable law will be in the Member States of the European Union.

    An example of a European directive, which has been implemented in Germany, is the „Fernabsatzrichtlinie“. In this directive, the European legislature had issued rules on the rights and obligations applicable to people who buy and sell, for example, on Ebay or Amazon. So it was about Internet shops, orders via a catalog and other contracts, where buyers and sellers are not like in a store. The „Fernabsatzrichtlinie“ was abolished with effect from 13 June 2014 by means of consumer rights directive - in the now also the remote paragraph regulates.

    The European union got a lot of influence on the laws of the country members of the eu. Sometimes they will forbid a law that a country want to introduce and if u want to join the eu u have to suffice to a lot of rules and laws.
